1. Usage Terms

By creating an account and using GutWell AI, you agree to these Terms of Service. GutWell AI is intended for personal wellness tracking only. You must be at least 16 years old to use this app. You are responsible for maintaining the confidentiality of your account credentials.

2. Health Disclaimer

GutWell AI is a wellness tracking application, not a medical device. The information, scores, patterns, and insights provided are for personal tracking purposes only and do not constitute medical advice, diagnosis, or treatment. It is not intended to diagnose, treat, cure, or prevent any disease.

Always seek the advice of a qualified healthcare professional with any questions regarding a medical condition. Never disregard professional medical advice or delay seeking it because of information provided by GutWell AI.

3. AI-Generated Analyses

Meal analyses are generated by a third-party AI service. They are suggestions only and may be inaccurate, incomplete, or unsuitable for your situation. The AI may misidentify foods or misread context, and its output is not reviewed by a medical professional before you see it.

You are free to correct, question, or disregard any analysis. What data is sent for analysis is described in our Privacy Policy.

4. Subscription Terms

GutWell AI offers a free tier and an optional Premium subscription, available as a monthly or an annual plan. Premium subscriptions are billed through Apple’s App Store. Payment is charged to your Apple ID account at confirmation of purchase.

Subscriptions renew automatically unless cancelled at least 24 hours before the end of the current billing period, and your account is charged for renewal within 24 hours before the end of the current period. Prices are shown in the app in your own currency before you purchase.

5. Cancellation Policy

You may cancel your subscription at any time through your Apple ID account settings. Cancellation takes effect at the end of the current billing period. Refunds are handled by Apple under Apple’s refund policy; GutWell AI does not process refunds directly. Free features remain accessible after cancellation.

Your mandatory statutory rights as a consumer are not affected.

6. Liability

GutWell AI is provided with care, but we do not warrant that it will be uninterrupted or error-free, and AI-generated analyses may be inaccurate or unsuitable for your situation.

Nothing in these Terms excludes or limits liability where such exclusion or limitation is not permitted by law — including liability for intent, for injury to life, body, or health, and under mandatory product-liability rules. Your mandatory statutory rights as a consumer remain unaffected.

7. User Content

You retain ownership of all data you enter into GutWell AI. By using the service, you grant us a limited licence to process your data solely for the purpose of providing the GutWell AI service. We do not sell your personal health data to third parties. You may export or delete your data at any time.

8. Acceptable Use

You agree not to misuse the service, including but not limited to:

• attempting to access other users’ data
• reverse-engineering the app
• using automated tools to interact with the service
• using GutWell AI for any unlawful purpose

9. Changes to Terms

We may update these terms from time to time. We will notify users of material changes through the app or via email. Where applicable law requires your express consent to a change, we will ask for it.

10. Governing Law

These Terms are governed by the law of the Federal Republic of Germany. If you are a consumer, this choice of law does not deprive you of the protection afforded by mandatory provisions of the law of the country in which you habitually reside, and it does not remove any right you may have to bring proceedings before the courts of that country.

11. Apple App Store

GutWell AI is distributed through Apple’s App Store. Apple is not a party to these Terms. Your use of the app is also subject to Apple’s applicable terms, and Apple’s standard Licensed Application End User License Agreement applies to the app.
